Navigating Orange Book Listings

Under Hatch-Waxman, the Food and Drug Administration requires new drug applications to be accompanied by certain patent information, which the FDA then lists in its Approved Drug Products with Therapeutic Equivalence Evaluations publication, also known as the Orange Book. Iancu, the Supreme Court addressed the question of “[w]hen the Patent Office initiates an inter partes review, must it resolve all of the claims in the case, or may it choose to limit its review to only some of them?” The Court found that, contrary to the prior USPTO practice, the Board may not limit institution to only some of the challenged claims. Trenton Ward and Rachel Emsley on Oil States Energy Services, LLC v. Greene's Energy Group, LLC and SAS Institute v. Matal
30/04/2018 Duración: 17minOn April 24, 2018, the Supreme Court handed down two opinions in cases related to inter partes review (IPR). In a 7-2 decision, the Court upheld the constitutionality of IPRs in Oil States Energy Services, LLC v. Greene's Energy Group, LLC. Then, in SAS Institute v. Matal, the Court ruled 5-4 that the Patent Trial and Appeal Board must review all challenged IPR claims or none at all.
